Our Company has been a leading outsourcer of tiles. One of the several suppliers of vitrified tiles is a Chinese Company, imports from whom have been exempted by the Government from attracting anti dumping duty. An appeal was filed by one of the other Indian manufacturers of tiles before CESTAT challenging the notification issued by the Government exempting the import from this particular manufacturer from levy of anti dumping duty. We are not a party to the litigation but understand that CESTAT has passed an Order (copy of which is not available as yet) striking down the notification. While the ramifications of the CESTAT Order would be known only after a copy is received, we have been legally advised that the CESTAT Order would become effective only after it is accepted by the Government. Past imports should not impact and therefore, the Company does not anticipate any liability. Further, given the fact that we import tiles from several manufacturers whom are similarly exempted, the CESTAT Order would not impact our business. The Company will take necessary steps to file appeal against the CESTAT Order and has been advised that it should succeed in its efforts
