Subsequent to withdrawal of suspension on Toll Notification by the State of Maharashtra and pursuant to the directions of the Honourable Bombay High Court to the State of Maharashtra to provide police protection to each of the toll plaza of the Project, IRB Kolhapur Integrated Road Development Co. Pvt. Ltd., wholly-owned SPV of the Company, has commenced toll collection on the Project effective from October 17, 2013.

Talegaon Amravati BOT Project implemented by wholly-owned SPV of the Company viz. IRB Talegaon Amravati Tollways Pvt. Ltd (SPV), has been issued a Provisional Certificate by the Competent Authority effective April 24, 2013. The Project has been commissioned in stipulated time. Consequently, the SPV has started partial toll collection on this project effective April 26, 2013. About Talegaon Amravati BOT Project : The Project involves Four-Lanning of Talegaon Amravati Section of NH 6 from Kms 100.000 to Kms 166.725. The Concession period is 22 years. Estimated Cost of the Project is Rs. 880 Crore and the Company had bagged this Project on Viability Gap Funding (VGF) basis and sought Rs. 216 Crore as VGF from NHAI.

Company's wholly-owned subsidiary company viz. IRB Westcoast Tollway Pvt. Ltd. ("SPV") has executed Concession Agreement with NHAI for the project of Four Laning of Goa/Karnataka Border to Kundapur section of NH-17 from Km 93.700 to Km 283.300 in the State of Karnataka under NHDP phase IV on Design, Build, Finance, Operate and Transfer (Toll) Basis (the "Project"). The Project is to be executed on DBFOT pattern with a concession period of 28 years. Scope of work involves upgradation of existing section of NH-17 between Goa/Karnataka Border and Kundapur from existing 2 lane highway to 4 lane highway. Estimated project cost is approx. Rs. 2600 crores and the construction is to be completed within 910 days from the appointed date. The SPV will get tolling rights on NH - 17 upon completion of construction. The grant sought by the SPV from NHAI is Rs. 536.22 crores.14 Mar · Updates
This is with reference to our earlier disclosure dated September 10, 2012 regarding Order/s of the Commissioner of Service Tax, Mumbai passed against the SPVs (ie. Subsidiaries) of IRB Infrastructure Developers Ltd. In these Order/s, the Service Tax Department had considered these Special Purpose Vehicles (SPVs) as an "Agent" of the NHAI/ State authorities instead of as "Concessionaire" under BOT Contracts and had therefore classified Toll Collection Activity as "Business Auxiliary Service". These SPVs had filed appeal/s in Hon'ble Custom Excise & Service Tax Appellate Tribunal (Tribunal) against Order/s of the Commissioner of Service Tax demanding service tax of Rs. 288.49 Crores, penalty of equivalent amount and proportionate interest thereon on toll collected from FY 06-07 to FY 10-11 under its BOT contract/s as per concession agreements entered into with the Government Authorities. Please note that the Hon'ble Tribunal has allowed the appeal/s of these SPVs and has observed that the appellants are not liable to pay service tax as they are not providing business auxiliary service to NHAI/ State authorities. In this connection, the Hon'ble Tribunal relied upon CBEC Circular dated 22.02.2012 and set aside the entire demand of service tax raised by the Commissioner of Service Tax, Mumbai
